The lawyer thought he was about to hear a routine ruling. Then the judge looked directly at him and said four words: “Counsel, approach the bench.”
The courtroom had been quiet all morning.
The attorney had spent nearly an hour presenting his client's case. His argument was confident, his documents were organized, and nothing appeared unusual.
Then the opposing attorney objected.
The judge paused.
He looked down at the documents in front of him, then slowly looked toward the lawyer.
“Counsel, approach the bench.”
The lawyer stood and walked toward the judge.
The courtroom became noticeably quieter.
Whatever was about to be discussed would not be heard by the jury.
The lawyer leaned toward the bench.
The judge lowered his voice.
“I have a question about the document you submitted.”
The lawyer immediately looked concerned.
“What about it, Your Honor?”
The judge pointed to a specific page.
“This date doesn't match the evidence presented earlier.”
For a moment, the lawyer said nothing.
He looked at the document.
Then he looked back at the judge.
The courtroom was waiting.
The lawyer finally realized what had happened.
The document he had relied on contained a date that contradicted an earlier statement in the case.
The opposing attorney remained at the table, watching silently.
The judge continued.
“Can you explain this?”
The lawyer took a breath.
“Yes, Your Honor.”
But the confident tone he had used only minutes earlier was gone.
He explained that the document had been provided to his office by another party and that he had not realized the discrepancy before presenting it.
The judge listened carefully.
Then he asked one more question.
“Did you verify it before presenting it to the court?”
The lawyer hesitated.
“No, Your Honor.”
The courtroom remained silent.
The judge returned to his chair and asked both sides to remain at the bench for a private discussion.
What had started as a routine objection had suddenly become a serious question about the reliability of evidence presented to the court.
And the lawyer now faced a decision.
He could continue defending the document.
Or he could acknowledge the mistake.
After a brief discussion, the lawyer chose the second option.
“Your Honor, I believe the court should disregard that document until we can verify the information.”
The judge nodded.
The immediate issue was resolved.
But the atmosphere in the courtroom had changed completely.
The lawyer returned to his table.
His opposing counsel looked at him.
Neither said a word.
For the rest of the hearing, every document was examined more carefully.
