Elon Musk Ordered to Appear in Court Over Chi.ld Custody Case with Ashley St. Clair

Billionaire Elon Musk has been summoned to court to address a paternity and custody lawsuit filed by author Ashley St. Clair, according to People.

The New York Supreme Court has ordered Musk, 53, to appear in court on May 29. The legal debate will center around whether Musk must undergo a paternity test, whether St. Clair will receive sole custody, and what the child support arrangements will be. The case is being overseen by Judge Jeffrey H. Pearlman.

Legal Dispute Over Paternity and Custody

Ashley St. Clair’s lawyer, Karen B. Rosenthal, stated that Musk has not yet responded to the court’s request. She emphasized that Musk already has legal representation in New York, where St. Clair filed the lawsuit and resides.

"He has prolonged this issue and caused unnecessary distress. We have no one to engage in a proper discussion with," Rosenthal told the press.

St. Clair filed the custody lawsuit on February 21, asserting that her son, R.S.C., was born in September 2024. She claims Musk was not present at the birth and has only met his son three times, with minimal involvement in his care.

Relationship Timeline & Musk’s Alleged Acknowledgment

According to St. Clair, she and Musk were in a romantic relationship starting in February 2023, and he acknowledged paternity in several text messages after the child’s birth.

  • First visit: Musk met R.S.C. on September 21, 2024, and spent two hours with him.
  • Second visit: The next day, he spent one hour with his son.
  • Final visit: On November 30, 2024, Musk met R.S.C. for 30 minutes.

On February 14, 2025, St. Clair made headlines by publicly revealing she had secretly given birth to Musk’s child five months prior, stating that she spoke out to protect her son from negative rumors. The following day, she shared details of her relationship with Musk in an interview with NY Post.

Born in 1999, St. Clair is a children’s book author known for Elephants Are Not Birds (2023). She is also a conservative commentator with over one million followers on X (formerly Twitter). She has appeared on Fox News, podcasts, and online shows, often discussing topics like declining birth rates in wealthy nations.

Musk’s Expanding Family

Elon Musk has 13 children with three other women:

  • First marriage (Justine Wilson): They had six children, though their first child passed away at 10 weeks.
  • With singer Grimes: They have three children.
  • With Neuralink executive Shivon Zilis: They have four children, including twins born just weeks before Grimes had her third child.
  • On February 28, 2025, Zilis announced she had welcomed a fourth child with Musk.

Grimes’ Plea for Musk’s Attention

On February 20, 2025, Grimes posted on X, pleading with Musk to respond to her messages, as one of their children was facing a serious health issue. As of now, Musk has not publicly responded to her request.
